Overview

Welcome to Backpocket Apps LLC ("we," "us," or "our"). By downloading, accessing, or using any of our mobile applications ("Apps"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Apps.

1. Description of Service

Backpocket Apps builds purpose-built mobile applications for life's everyday moments. We may add, modify, or discontinue Apps or features at any time.

2. Trademark Disclaimer

Our Apps are independent products and are not affiliated with, endorsed by, sponsored by, or associated with any third-party brands, publishers, manufacturers, or trademark holders. All third-party names, logos, and trademarks mentioned within our Apps are the property of their respective owners. References to third-party products or brands do not imply any relationship with or endorsement by their respective owners.

3. User Accounts

Some features of our Apps may require you to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to provide accurate and complete information when creating an account and to update your information as necessary.

4. Subscriptions and Payments

Our Apps may offer both free and paid features. Paid features may be offered as subscriptions or one-time purchases, depending on the App. By making a purchase, you agree to the following:

Subscriptions are billed on a recurring basis (monthly or annually) unless canceled. You may cancel your subscription at any time through your device's app store settings. Cancellation will take effect at the end of your current billing period. Refunds are handled according to the policies of the Apple App Store or Google Play Store, as applicable. We reserve the right to change pricing with reasonable notice.

5. User-Generated Content

Our Apps may allow you to create, submit, or share content such as photos, text, custom templates, or other materials ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content within our Apps. You represent that you own or have the necessary rights to submit your User Content and that it does not infringe on any third-party rights. We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable.

6. Intellectual Property

Our Apps, including their design, features, and content (excluding User Content and third-party trademarks), are owned by Backpocket Apps LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Apps without our prior written consent.

7. Acceptable Use

You agree not to use our Apps to: violate any applicable laws or regulations; infringe on the rights of others; submit false, misleading, or fraudulent information; upload malicious code or interfere with the Apps' operation; or use the Apps for any unauthorized commercial purpose.

8. Limitation of Liability

To the fullest extent permitted by law, Backpocket Apps LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Apps. Our total liability for any claims arising from your use of our Apps shall not exceed the amount you paid us in the twelve (12) months preceding the claim. Our Apps are provided "as is" without warranties of any kind, either express or implied.

9. Indemnification

You agree to indemnify and hold harmless Backpocket Apps LLC, its officers, members, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of our Apps, your User Content, or your violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to any of our Apps at any time, with or without cause, and with or without notice. Upon termination, your right to use the affected Apps will immediately cease.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms within our Apps or on our website. Your continued use of our Apps after such changes constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the District of Columbia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our Apps shall be resolved in the courts located in the District of Columbia.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Apple App Store Terms

For users who download our Apps from the Apple App Store, this Agreement incorporates by reference the Licensed Application End User License Agreement (the "Standard EULA") published by Apple, Inc., available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

You acknowledge that this Agreement is concluded between you and Backpocket Apps LLC only, and not with Apple, Inc. Backpocket Apps LLC, not Apple, is solely responsible for the Apps and their content. Apple has no obligation to provide maintenance, support, or warranty services for the Apps. In the event of any failure of an App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price; beyond that, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the Apps, including product liability, legal compliance, or intellectual property infringement. Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.
